Contractor / Service Provider Responsibility Acknowledgment

This acknowledgment applies to equipment owners, operators, contractors, businesses, and service providers who request to list services on USDirtMovers.com.

This page is provided as website disclosure language and should be reviewed by a qualified attorney before launch.

1. Independent Contractor Status

I understand that USDirtMovers.com is an online listing and connection platform only. USDirtMovers.com does not employ me, supervise me, direct my work, control my pricing, inspect my equipment, manage my schedule, or guarantee the quality, safety, legality, or completion of any work I perform. I acknowledge that I am acting as an independent contractor, equipment owner, operator, business, or service provider, and not as an employee, agent, partner, representative, subcontractor, or joint venturer of USDirtMovers.com.

2. Responsibility for Services Performed

I understand and agree that I am solely responsible for all services I offer, quote, schedule, perform, supervise, or complete through any customer contact made as a result of my listing on USDirtMovers.com. This responsibility includes, but is not limited to, the quality and completion of my work; the safe operation of my equipment; the accuracy of my listing information; my pricing, estimates, invoices, and payment arrangements; any damage to property, structures, driveways, landscaping, fences, utilities, vehicles, equipment, or other assets; any injury, claim, dispute, loss, delay, or incident arising from my work; cleanup, restoration, repair, or correction of work when applicable; and compliance with all applicable laws, rules, regulations, permits, licensing, insurance, and safety requirements. I understand that USDirtMovers.com is not responsible or liable for any work I perform, fail to perform, agree to perform, quote, cancel, delay, damage, or otherwise affect.

3. No Screening, Verification, or Endorsement by USDirtMovers.com

I understand that USDirtMovers.com may allow service providers to submit listings for review, but USDirtMovers.com does not guarantee, certify, verify, screen, background check, license-check, insure, bond, train, monitor, or endorse me or any other listed provider. Approval of a listing, if granted, means only that the listing may appear on the website. It does not mean USDirtMovers.com has verified my qualifications, insurance, license status, experience, safety record, equipment condition, or suitability for any job. I agree not to state, imply, advertise, or represent that I am employed by, certified by, endorsed by, guaranteed by, insured by, bonded by, or directly affiliated with USDirtMovers.com unless USDirtMovers.com provides express written permission.

4. Accuracy of Listing Information

I certify that the information I submit is accurate and truthful to the best of my knowledge. This includes my name or business name, contact information, service area, ZIP code, travel radius, equipment owned or operated, services offered, and any additional details I provide. I agree to update or request removal of my listing if my information changes, if I stop offering certain services, if I sell or lose access to listed equipment, or if I am no longer available to perform the listed work.

5. Licensing, Insurance, Permits, and Legal Compliance

I understand that I am solely responsible for determining and maintaining any license, registration, permit, certification, insurance, bonding, business authorization, tax registration, or other requirement that may apply to my work. I agree that before accepting or performing any job, I will determine whether the work requires a permit, license, inspection, insurance coverage, written agreement, special authorization, or compliance with local, state, or federal rules. I understand that laws and requirements vary by location and by type of work. I agree that USDirtMovers.com is not responsible for advising me, the customer, or any property owner about legal, licensing, permitting, insurance, tax, or regulatory requirements.

6. Underground Utilities, Private Lines, and Hidden Assets

I understand that dirt work, excavation, trenching, grading, brush clearing, driveway work, drainage work, land clearing, demolition cleanup, hauling, and similar services can create serious risks if underground utilities or hidden property features are present. Before beginning any work that disturbs the ground, I agree that I am responsible for confirming that appropriate underground utility location steps have been completed. This includes, when applicable, contacting 811 or the appropriate state or local utility notification center before digging, allowing time for utilities to be marked, and following all applicable safe-digging requirements. I also agree to communicate with the homeowner, property owner, tenant, general contractor, or authorized customer before work begins to identify and discuss the possible location of underground or hidden assets, including but not limited to electric lines, gas lines, water lines, sewer or septic lines, irrigation systems, drainage pipes, fiber, cable, internet, phone lines, propane lines, private utility lines, invisible dog fences, sprinkler systems, landscape lighting lines, well lines, private electrical feeds to sheds, barns, gates, shops, or detached garages, buried tanks, culverts, pipes, structures, survey markers, property pins, easements, boundary features, and any other underground, hidden, or sensitive property assets. I understand that 811 or public utility markings may not identify all private lines, owner-installed lines, septic components, irrigation systems, drainage systems, or other non-public utilities. I agree that I am responsible for discussing these possibilities with the customer and taking reasonable precautions before work begins. I agree not to begin work until I have made reasonable efforts to confirm that utility marking, property-owner communication, and safe-digging precautions have been addressed for the scope of work being performed.

7. Jobsite Inspection and Safety

I agree that I am responsible for inspecting the jobsite before beginning work and for determining whether the site is safe and appropriate for the services I plan to perform. This includes considering access, slope, soil condition, overhead lines, underground hazards, wet or unstable ground, structures, fences, driveways, retaining walls, septic systems, drainage features, nearby people, animals, vehicles, and any other condition that could affect safe performance of the work. I agree to operate equipment safely and only within my ability, experience, equipment limits, and applicable safety requirements. I agree to stop work if conditions appear unsafe, unclear, unauthorized, or beyond the agreed scope.

8. Customer Agreements, Pricing, and Payment

I understand that all estimates, quotes, pricing, scheduling, payment terms, deposits, refunds, cancellations, warranties, workmanship expectations, and job details are strictly between me and the customer. USDirtMovers.com is not a party to any agreement between me and a customer unless expressly stated in writing by USDirtMovers.com. I agree that I am responsible for clearly communicating my pricing, scope of work, payment terms, limitations, exclusions, and expectations directly with the customer before beginning work.

9. Disputes, Damage, Claims, and Indemnification

I agree that any dispute, claim, damage, injury, loss, payment issue, workmanship concern, property damage concern, utility strike, accident, or disagreement arising from my services is between me and the customer or affected party. To the fullest extent permitted by law, I agree to release, defend, indemnify, and hold harmless USDirtMovers.com, its owners, operators, representatives, affiliates, and agents from and against any claims, demands, damages, losses, liabilities, costs, expenses, attorney fees, disputes, or causes of action arising out of or related to my listing, my communications with customers, my estimates, quotes, agreements, services or failure to perform services, equipment operation, jobsite damage, utility damage, personal injury, property damage, payment disputes, inaccurate or misleading information I provide, or violation of law, permit rules, safety rules, or utility-location requirements.

10. Right to Remove or Decline Listings

I understand that USDirtMovers.com may approve, reject, edit, suspend, or remove listings at its discretion. I understand that USDirtMovers.com may remove my listing if information appears inaccurate, unsafe, misleading, inappropriate, incomplete, or inconsistent with the purpose of the website, or if complaints, disputes, legal concerns, or other issues arise.

11. Final Confirmation

By checking the acknowledgment box and submitting my application, I confirm that I have read, understood, and agree to this Contractor / Service Provider Responsibility Acknowledgment. I further confirm that I understand USDirtMovers.com is only a connection platform and that I am solely responsible for the work I offer and perform.
